Terms of Use

These terms are an agreement between you and sole proprietor Sverediuk O. V. (Ukrainian FOP, tax ID 3423602956) (“Bookly”, “we”). By creating an account or using the service you agree to them. If you accept these terms on behalf of a company, you confirm that you are authorised to do so.

What Bookly is

Bookly is an online service where a business takes online bookings, keeps a client base and visit history, manages staff and their schedules, sells services and products, collects enquiries and reviews, publishes a link-in-bio page with short links, and sees analytics. Part of this is available in the mobile apps and through the Telegram bot.

The exact set of features depends on your plan and may change: we keep developing the service, add new capabilities and occasionally retire ones that are no longer used.

Your account

  • You need an account to use the service. The details you give at sign-up must be accurate and kept up to date.
  • You are responsible for keeping your password safe and for everything done through your account. If you work with client data, turn on two-factor authentication.
  • If you suspect someone else has gained access to your account, write to support@bookly.me immediately and change your password.
  • One account belongs to one business. You may invite staff members and give them roles with different permissions; you remain responsible for what they do in the service.

Plans, trial and payment

  • Some features are free, the rest are part of paid plans. Current prices are always shown on the pricing page.
  • A trial period, where offered, opens paid features for a limited time and does not oblige you to subscribe.
  • A paid subscription renews automatically for the same period until you cancel before the next charge. You can cancel at any time in your account settings; the service keeps working until the end of the paid period.
  • Payments are handled by payment providers. The price of a subscription is fixed at payment; we can change the price of an existing subscription only from the next period and only with advance notice, as set out in the Public offer.
  • If a payment fails, we may limit access to paid features until it is settled. Your data is preserved in the meantime.
  • Paid access to Bookly — plans, payment, renewal, price changes and refunds — is governed by the Public offer. Where these terms and the offer differ on paid access, the offer applies.

How you may and may not use the service

By using Bookly you undertake not to:

  • break the law or infringe other people’s rights, including by publishing content you have no rights to;
  • send clients spam or messages they have not agreed to receive;
  • publish deceptive, hateful or harmful content, or impersonate another brand or person;
  • attempt to break the service, bypass its technical limits, overload it with automated requests, or access other users’ data;
  • resell the service or give third parties access to it as your own product without our written consent.

Your content and your clients’ data

  • Everything you create or upload in Bookly stays yours. You grant us only the rights we need to store, display and process that content so the service can work.
  • Your clients’ data in Bookly belongs to you as the controller; we process it on your instructions. You must have a lawful basis to collect it and must tell your clients how it is used. See the Privacy Policy for details.
  • You are responsible for the accuracy and lawfulness of what you publish on your public pages: prices, service descriptions, booking conditions and the promises you make to clients.
  • We may remove content that breaks the law or these terms, and we will tell you when we do so where that is possible.

Our rights in the service

The service itself — its code, design, interfaces, name and logo — belongs to us and is protected by intellectual property law. These terms grant you no rights in the service other than the right to use it as intended while your account is active.

Availability and support

  • We aim to keep the service running without interruption, but we do not guarantee it: scheduled maintenance, updates and outages at our providers are possible.
  • We may add, change or discontinue individual features. If a change materially reduces what a paid plan includes, we will announce it in advance.

Suspension and termination

  • You may stop using the service and delete your account at any time in the settings.
  • We may suspend or close an account that breaches these terms or the law, or that threatens the service or the safety of other users. Where circumstances allow, we warn you first and give reasonable time to fix the problem.
  • After termination we delete or anonymise your data within the periods described in the Privacy Policy. We recommend exporting what you need before closing the account.

Disclaimers and limits of liability

  • The service is provided “as is” and “as available”. We do not warrant that it will suit a particular business purpose or deliver a specific commercial result.
  • We are not liable for lost profits, lost clients, lost data or other indirect losses arising from using the service or being unable to use it.
  • We are not liable for interruptions and delays in the service caused by force majeure, including hostilities and martial law, attacks on the power grid or communication networks, power outages, cyberattacks or decisions of the authorities, for as long as these circumstances last.
  • To the extent permitted by law, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
  • Nothing here limits liability that cannot be limited by law, including liability for intentional acts.

Governing law and disputes

These terms are governed by the law of Ukraine. We prefer to talk first: write to support@bookly.me and we will try to resolve the matter informally. If that does not work, the dispute is heard by the competent courts of Ukraine.

Changes to these terms

We may update these terms. The date at the top of the page shows the current version, and we announce material changes in advance. Continuing to use the service after the changes take effect means you accept them. If you do not agree, stop using the service and close your account.
